Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") are a contract between you and KUBOYA Inc., a Japanese company with its registered address at 3-1 Nihonbashi-Tomizawacho, Chuo-ku, Tokyo, Japan ("we," "us," "our"). By downloading, installing, or using the Brambin EQ mobile application (the "App") or this website (collectively, the "Service"), you agree to these Terms. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed these Terms with you and consents on your behalf.

The Service is not designed for and must not be used by anyone in a capacity where a diagnosis or a therapeutic outcome is expected. See Section 5 for details.

3. The Service in plain language

Brambin EQ is a self-reflection and entertainment tool. It offers:

• A 44-question self-assessment about emotional intelligence, across five dimensions (self-awareness, self-regulation, motivation, empathy, social skills)
• An overall EQ score placed on a bell curve, a five-dimension radar chart, and a personal archetype
• A written, tier-specific analysis of your result
• The ability to re-take the assessment and track your profile over time

You can try the first eight questions for free. Unlocking the full 44-question assessment is a one-time in-app purchase.

4. Your account (there isn't one)

The Service does not require you to create an account, provide an email, a phone number, or any other personally identifying information. Your usage is tied to a random anonymous identifier assigned to your device. You remain responsible for the security of the device on which you use the Service.

5. Important: what the Service is not

Brambin EQ is not:

• A medical device or a medical service
• A psychological evaluation or clinical assessment
• A diagnostic instrument for any condition, including but not limited to depression, anxiety, ADHD, autism spectrum, alexithymia, or personality disorders
• A substitute for therapy, counseling, medication, or any form of professional health advice
• A tool for decisions about other people, including hiring, firing, promotion, custody, or legal matters

If you are experiencing serious emotional distress, please consult a licensed mental health professional or contact an emergency service. We are not able to help you in a crisis. Local resources are often easier to find than international ones; please use them.

6. Purchases, refunds, and renewals

The full assessment is a one-time purchase through Apple's In-App Purchase system. There is no subscription; the price you see is the price you pay, and you pay it once.

• Price: JPY 2,900 in Japan. In other markets Apple displays the price in local currency per Apple's pricing matrix.
• Refunds: handled by Apple, not by us. To request a refund, go to reportaproblem.apple.com and sign in with your Apple ID.
• Restore: if you reinstall the app on a new device, tap "Restore purchase." Your Apple ID will authenticate the transaction; we will mark your new device as already-purchased.
• Family Sharing: supported if you enable it in your Apple ID settings. The head of your Family Sharing group's purchase of Brambin EQ will unlock the full assessment for members of the group.

7. What you may not do

You agree not to:

1. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
2. Extract, reproduce, or redistribute the question set, scoring rules, or any copyrighted content from the Service
3. Resell access to the App or the assessment
4. Use the App's output as a basis for decisions about other people (hiring, firing, custody, medical, or legal) without their informed consent
5. Use the Service to impersonate another person or submit deceptive answers on their behalf
6. Attempt to circumvent any security, rate-limiting, or fraud-prevention mechanism we have implemented

8. Intellectual property

All content provided through the Service — including the question set, the scoring algorithm, the analytic text, archetypes, the user interface, the brand name "Brambin," and the related trade dress — is owned by KUBOYA Inc. or our licensors and is protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the App for your personal, non-commercial self-reflection. You do not acquire any other rights.

Your own answers and your own results belong to you. We store them on your behalf as described in the Privacy Policy. You can request export or deletion at any time.

9. Your data and privacy

Our collection, use, and retention of your data is described in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference. By using the Service you acknowledge that you have read it.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. To the maximum extent permitted by applicable law, we disclaim all implied warranties, including but not limited to the warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.

Without limiting the foregoing, we do not warrant that the results produced by the Service are accurate, reliable, reproducible, or applicable to any particular decision you might make. The Service is for self-reflection and entertainment.

11. Limitation of liability

To the maximum extent permitted by law, neither KUBOYA Inc. nor any of its officers, employees, or partners will be liable to you for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service — even if we have been advised of the possibility.

Our total cumulative liability to you for any claim arising out of or related to the Service is limited to the greater of:

1. The amount you actually paid us for the App (typically JPY 2,900 or the equivalent in your local currency), or
2. JPY 5,000

This limitation applies regardless of the legal theory on which the claim is based.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In those jurisdictions our liability is limited to the minimum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless KUBOYA Inc. from any claim, loss, or expense (including reasonable attorney's fees) brought by a third party arising out of your use of the Service in violation of these Terms, or your use of the Service's output to make decisions affecting third parties without their consent.

13. Termination

You may stop using the Service at any time by deleting the App from your device. Data deletion is described in the Privacy Policy.

We may suspend or terminate your access to the Service if we reasonably believe you have materially breached these Terms, or if we are required to do so by law. In the rare event we discontinue the Service entirely, we will provide at least 60 days' notice on this website and inside the App, and we will allow you to export your data.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced inside the App and posted on this page with a new Last updated date. Continued use of the Service after a material change constitutes acceptance of the updated Terms. Non-material changes (clarifications, typo fixes) will not be announced.

15. Governing law and jurisdiction

These Terms are governed by the laws of Japan, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Service that cannot be resolved amicably will be submitted to the exclusive jurisdiction of the Tokyo District Court (東京地方裁判所) as the court of first instance.

If you are a consumer in the European Union, nothing in this Section deprives you of the protection of mandatory consumer-protection laws of your country of residence.

16. Dispute resolution before litigation

Before bringing a formal claim, you agree to first contact us at support@brambin-eq.com and describe the issue. We will respond within 30 days and make a good-faith effort to resolve the matter informally.

17. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full effect. The invalid provision will be reformed to the minimum extent necessary to make it enforceable while preserving intent.

18. Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and KUBOYA Inc. regarding the Service. They supersede any prior agreement, representation, or understanding — oral or written.
